The new Administrative Review Tribunal (ART) begin its operations on 14th of October, claiming a more suitable and an effective federal review body replacing Administrative Appeals Tribunal (AAT). This announcement is an important step forward in the Albanese Government landmark reform to Australia’s system of Administrative review.
The ART aims to deliver administrative reviews that are fair and just, resolving applications promptly with minimal formality and cost. It seeks to be accessible and responsive to the diverse needs of parties involved. Additionally, the ART aims to enhance the transparency and quality of government decision-making, while fostering public trust and confidence in the tribunal.
The Honourable Justice Emilios Kyrou AO is the first President of the ART. He was appointed President of the AAT on June 9, 2023, after a transparent and merit-based selection process. He will guide the new Tribunal through its transition and serve for the rest of his term.
Transitioning from AAT to ART
- All ongoing matters before the AAT will continue normally during the reform process.
- Applicants do not need to submit new applications to the ART.
- Any cases unresolved by the Administrative Appeals Tribunal before October 14, 2024, will automatically transition to the ART.
- Finalised AAT decisions will not be reconsidered by the ART.
- The ART will maintain the same jurisdiction as the Administrative Appeals Tribunal, covering areas such as child support, workers’ compensation, social security, NDIS, migration and refugee visas, taxation, security, and veterans’ entitlements.
Appointments of Non-Judicial Deputy Presidents
The Australian Government has appointed six new non-judicial Deputy Presidents to the Administrative Appeals Tribunal, adding to the two previously announced on June 21, 2024. These appointees will start their terms at the AAT to maintain capacity before transitioning to the ART on October 14, 2024. The Government will announce more appointments to the AAT and ART soon.
