Fiancé Visa Australia
The prospective marriage visa, widely known as the fiancé visa, is a temporary visa that allows prospective spouses to enter Australia to marry their partner. If you are intending to marry an Australian citizen or eligible permanent resident, the fiancé visa is most likely to suit your needs.

Prospective Marriage Visa Requirements
The general prospective marriage visa requirements are:
- The visa applicant must be in a relationship with an Australian citizen, permanent resident, or eligible NZ citizen
- The visa applicant must be over 18 years old
- The visa applicant must be outside of Australia when they apply for this visa
- The visa applicant must be sponsored by, and intend to marry their partner
- The visa applicant must meet the health and character requirements
How It Works
The fiancé visa application is lodged online with the Department of Home Affairs (DOHA). The visa application consists of two parts – the application and the sponsorship. The visa applicant must first lodge their application, followed by the sponsor’s application.
After the Fiancé Visa Application is Granted
The fiancé visa will be granted for a duration of approximately 9 to 15 months. Once it is granted, you must enter Australia within that timeframe and must marry the sponsor. The marriage can be in Australia or overseas. Once you have married your sponsor, you can apply for the Partner Visa and this visa must be lodged before the fiancé visa expires.
Features of the Finance Visa
The benefits of becoming a holder of the fiancé visa are:
- Travel to Australia before getting married to your potential spouse
- Travel to and from Australia without any restrictions while the visa is valid
- Work in Australia
- Study in Australia
Love knows no boundaries, and neither do we.

Fiance Visa Requirements for Sponsors
An Australian citizen, permanent resident, or an eligible New Zealand citizen may sponsor an applicant for a Fiancé visa, unless they are prevented by certain limitations.
Sponsorship Limitations
There are some sponsorship limitations that may cause someone to not be able to sponsor their partner on the fiancé visa. For example:
- If the sponsor is a woman who held a Woman at Risk visa (subclass 204)
- The sponsor had previously sponsored their previous partner(s) on a partner visa or prospective marriage visa
- The sponsor had a criminal record(s)
If you are affected by any of the limitations above, do not jump to the conclusion that your application will result in failure. We highly recommended that you consult with our immigration lawyer or migration agent to strategise an argument for your case. Our team are experts in navigating through the challenges of a difficult case. If you are faced with ineligibility or refusal, please do not hesitate to contact us.
Partner Visa Character Requirements
The visa applicant must show that they pass the character test. As part of the application, the visa applicant must submit a police check from Australia and any other country where they have lived for more than 12 months.
Having a criminal history doesn’t automatically mean your application won’t succeed. We highly recommend consulting one of our immigration lawyers or migration agents to build a strong case. With our wealth of experience handling complex cases involving character issues, health issues, unlawful status, and more, we’re here to help you.
Partner Visa Health Requirements
The applicant must satisfy health requirements. In some cases, there are waivers available for applicants who have health issues.
