Temporary Skill Shortage (TSS) subclass 482 visa replaced the popular subclass 457 visa on 18 March 2018. It is a temporary work visa in the employer sponsored visa program. The TSS 482 visa help employers sponsor overseas workers, and for employees to enter or stay in Australia to work. For certain occupations, it has pathways to permanent residency. It has no age limit, which may be suitable for older applicants who wish to work in Australia.

The Three Streams of TSS Visa

There are three streams under the TSS work visa:
– Short-term Stream
– Medium-term Stream
– Agreement Stream

The pathway to permanent residency via the TSS 482 visa is available through the Medium-term and Agreement streams. The main difference between the three streams is the occupation under which the application is lodged.

The Australian Government publishes the list of relevant occupations for subclass 482 work visa applications under the Short-term and Medium-term stream, and the Agreement stream is available for employers who wish to sponsor workers whose occupation is not found on the list.

The Three Stages of TSS 482 Visa

There are three stages involved in the subclass 482 visa program:

The first stage of the subclass 482 visa is sponsorship. By becoming an approved sponsor, the employer can nominate as many employees as they need. The sponsorship is for five years and is renewable. There are two types of sponsors for TSS visa:
  • Standard Business Sponsor (SBS), and
  • Overseas Business Sponsor (OBS).
To be an approved sponsor, the employer must be lawfully and actively operating, and has no adverse records with the authority. Some businesses may also be able to apply for accredited status, and they will receive priority processing for all subclass 482 TSS visa applications. There are several sponsorship obligations that employers must comply with. Failure to do so may result in sanctions and, in some instances, hefty fines.

The second stage of the TSS 482 visa is for the employer to nominate an occupation that they genuinely need to be filled by the foreign worker. In this stage, the employer must show that they have attempted to source local labour market (unless exempted), that there is a genuine need for the position, and provide guaranteed earnings to the nominee that is in line with the Australian market salary rate or $70,000 per annum, whichever is higher.

For short-term and medium-term stream, the nominated occupation for the TSS visa must also be one that is listed in the relevant occupation list published by the Government.

The third and last stage of the subclass 482 visa is for the visa applicant, or the proposed employee, to demonstrate that he/she possesses the relevant qualifications, skills, and work experience that fits the genuine need of the employer/nominator.

 

Other requirements that the TSS visa applicant must satisfy, for instance, are that they must:

  • Have always complied substantially with their previous and current visas
  • Have at least 2 years of relevant work experience
  • Genuinely intend to work in the nominated position
  • Have adequate health insurance for their stay in Australia
  • Meet English, health, and character requirements

What Does the TSS 482 Visa Allow You to Do?

TSS subclass 482 visa can be granted for up to 4 years, and those in medium-term stream can be eligible for permanent residency after 3 years of holding the 482 visa and continuously working for the sponsor, provided that the sponsor is willing to nominate them for the permanent visa.

When in effect, it allows the TSS visa holder to work full-time with the employer or the associated entities of the sponsor, but no one else (unless for certain exempted occupations).

Dependents on this visa can work and study without restrictions.

Applying as a Subsequent Entrant Under the Subclass 482 Visa

If the visa applicant has a partner or children, they can lodge a combined TSS subclass 482 visa application at the same time. However, it is often the case that the primary visa applicant has a partner after he/she has been granted the TSS visa. In this instance, the dependent can lodge a separate, new TSS subclass 482 visa as a subsequent entrant. The requirement is to demonstrate that the dependent is a spouse, de facto partner, or child of the primary visa holder. The sponsor (employer) must also agree to extend their sponsorship to the family member(s) of the primary visa holder.

Yes, there is no age limitation for TSS visa.
Yes, you can. However, your partner may not be eligible for a bridging visa. We recommend you contact us before you add dependent who is overseas.
If your occupation is on the short-term skill occupation list (STSOL), you can renew the TSS visa once in Australia. Thereafter, you need to renew from offshore. However, since the COVID-19 pandemic, there are some exemptions on this restriction for certain applicants. On the contrary, TSS subclass 482 visa holder in the medium-term stream can renew in Australia without such limitation.
Children aged 18 to 22 years old can be included as dependents on your TSS 482 visa. However, you need to show that your children are dependent on you. Children over 23 years old can only be included if they are incapacitated for work due to partial or total loss of physical or mental functions.

If you are in the medium-term stream, you will be eligible for PR after 3 (three) years holding the TSS subclass 482 visa (unless concessions apply). If you are in the Agreement stream, it depends on the Agreement between your sponsor and the Australian Government.
