Training visa (subclass 407) is a temporary visa that allows the holder to participate in workplace-based occupational training to improve skills, obtain mandatory registration/licensing, or take part in a professional development training program in Australia.

The Three Types of Occupational Training for the 407 Visa

There are 3 types of occupational training:

  • Occupational Training required for Registration
  • Occupational Training to Improve Skills
  • Occupational Training for Capacity Building Overseas

This type is suitable for 407 visa applicants who need to undertake training for them to obtain the necessary registration, membership, or licensing in Australia or in their home country in their profession. Therefore, it is expected that the applicant already has relevant qualifications and experience to undertake the occupational training.

This type is suitable for applicants who have some work experience (at least 12 months of full-time experience in the past 24 months before the application), however, need to participate in occupational training to enhance their skills.

Only occupations listed in the relevant skilled occupation list can be nominated under this type of Training visa 407. The nominator or employer must also demonstrate that they have the capacity and resources to deliver the proposed training activities, which are structured, workplace-based specifically tailored to the applicant (not a generic training program).

There are two subtypes of the occupational training program for capacity building overseas, namely for those applicants who are supported by a government agency (or the government of the applicant’s home country) and those who are employed by an overseas employer in a managerial position to undertake face-to-face training (like in a classroom) for their professional development.

The Three Stages of 407 Training Visa

There are 3 stages involved:

The first stage of this visa is sponsorship. By becoming an approved sponsor, the employer can nominate as many applicants as they need. The sponsorship is for 5 years and is renewable. The type of sponsor for this visa is a Temporary Activities Sponsor (TAS).

To be an approved sponsor for the Training visa, the employer must be lawfully and actively operating, has the capacity to provide the proposed activities, and has no adverse records with the authority.

There are several sponsorship obligations that the Training 407 visa employers must comply with. Failure to do so may result in sanctions and, in some instances, hefty fines.

The second stage of the Training 407 visa is nomination. In this stage, the sponsor must demonstrate that they do not engage in activities that will have adverse consequences for employment or training opportunities for Australians and present the training plan (if it is a structured training plan to enhance skills). That is, the nominated program is a genuine training opportunity for the intended purpose.

The applicant will also need to demonstrate their qualifications, English language ability, and relevant work experience in this stage. The position can be either a paid position or a voluntary position (unpaid).

For occupational training to enhance skills type, the nominated occupation for the 407 Training visa must also be one that is listed in the relevant occupation list published by the Government.

The third and last stage of the Training visa 407 is for the visa applicant to again show their English ability, their relevant qualifications, skills, and work experience, as well as their capacity to support themselves in Australia (in this program, it can also be a voluntary role, without the visa applicant receiving s

alary).

Other requirements that the applicant must satisfy, for instance, are they must:

  • Have adequate health insurance
  • Genuinely intend to stay in Australia temporarily (also known as genuine temporary entrant/GTE criteria)
  • Meet health and character requirements

What Does the Subclass 407 Visa Allow You to Do?

This visa can be granted for up to 2 (two) years; however, it must be consistent with the proposed activities. For instance, if an applicant only needs 6 months to obtain the necessary registration for his/her occupation, then the 407 Training visa will only be granted for 6 months.

When in effect, it allows the visa holder to participate in the proposed training activities. Dependents on this visa can only work 40 hours per fortnight.

Applying as a Subsequent Entrant Under the 407 Training Visa

If the visa applicant has a partner or children, they can lodge a combined Training visa application at the same time. However, it is often the case that the primary visa applicant has a partner when he/she has been granted the visa. In this instance, the dependent can lodge a separate, new 407 Training visa as a subsequent entrant.

The requirement is to demonstrate that the dependent is a spouse, de facto partner, or child of the primary visa holder.
